Assembly Member Ting brought new life back into a bill that will require California cities that voted for Proposition 64 to open medical cannabis stores. Assembly Member Ting stopped AB-1356 during the last legislative session after the League of California Cities opposed the bill. The bill is scheduled for a third vote in the Assembly. 

An analysis of the legislation indicates that 76% of Californian cities ban medical storefronts as well as 69% of the counties. Assembly Member Ting believes that the legislation will help curb the black market and promote access to medical cannabis products.

The number of medical cannabis stores that a city will be required to open will be based on the active number of liquor store licenses in the city. The amended bill reduced the number of medical cannabis permits that a city must offer from 25% of liquor store licenses to 16.6%. If the number results in a ratio greater than one than the city can limit the number of stores to one for every 15,000 residents in the city.

Cities that obtained a ballot vote on cannabis businesses on or after January 1, 2017 are exempt from this requirement. The bill also allows a city to reduce the number of required medical cannabis stores if a majority of voters support a ballot measure that contains an ordinance limiting medical cannabis dispensaries in the next upcoming election.

EAZE ANNOUNCES $35 MILLION INVESTMENT TO LAUNCH VERTICAL OPERATIONS AND INCREASE CANNABIS ACCESS FOR 600,000+ CUSTOMERS

Reports 71 Percent Annual Increase in Overall Deliveries and 74 Percent Annual Increase in First-Time Deliveries

Eaze, California’s largest legal cannabis marketplace, announced today it has closed a $20 million investment and secured the ability to raise up to an additional $20 million to complete its Series D funding, inaugurating Eaze’s verticalization and brand strategy to expand access to safe, legal, and affordable cannabis products.

The $20 million from Series D investors -- led by FoundersJT LLC -- joins a $15 million bridge round led by Eaze key stakeholders, Rose Capital and DCM.

Eaze Chief Executive Officer Ro Choy said, “Verticalization is Eaze’s second act. Until now, we’ve invested in proving our market fit, building an enormous and loyal customer base, and becoming California’s biggest marketplace for legal cannabis delivery. Now, we’re proving we can make this business work in a more sustainable and profitable way, while continuing to grow Eaze’s existing services.”

In January, Eaze acquired DionyMed Brand’s rights to retail licensee Hometown Heart (HTH) depots in Oakland and San Francisco, and now has oversight of HTH’s day-to-day operations. In the coming weeks, Eaze will launch its own line of consumer brands in partnership with local licensees while continuing to support a broad array of independent, world-class California brands and independent licensed retailers across the state.

Despite challenges to California’s legal cannabis industry, the company experienced significant growth in 2019, as reported in the latest Eaze Insights: State of Cannabis Report. Highlights for 2019 include:

  • 97% annual increase in new sign-ups

  • 74% annual increase in first-time deliveries

  • 71% annual increase in overall deliveries

  • 104% annual increase in customers age 50+

Eaze also announced the promotions of Megan Miller to Chief Operating Officer and John Curtis to Chief Financial Officer. Miller, who previously served as Eaze’s Vice President of Finance and Marketplace, brings a unique combination of deep financial planning skills and comprehensive understanding of Eaze’s business to her new role. Curtis, who has served as interim CFO since October 2019, has been instrumental in sizing Eaze’s business and charting the company’s path forward to verticalization.

The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA), which was signed into law in June 2017, creates the general framework for the regulation of commercial medicinal and adult-use cannabis in California. The text of MAUCRSA is available on the California Legislative Information website.

MAUCRSA also established a dual licensing structure in which both the state and local governments participate in setting guidelines and public health standards for the industry. The state sets minimum requirements that all licensees must follow, and local governments are able to set additional requirements.

2017 – The California State Legislature passed a budget trailer bill, Senate Bill 94, that integrated MCRSA with AUMA to create the Medicinal and Adult‐Use Cannabis Regulation and Safety Act (MAUCRSA). Under MAUCRSA, a single regulatory system governs the medicinal and adult-use cannabis industry in California.

2016 – California voters passed Proposition 64, the Adult Use of Marijuana Act (AUMA). Under Proposition 64, adults 21 years of age or older can legally grow, possess, and use cannabis for non-medicinal purposes, with certain restrictions. Additionally, AUMA also made it legal to sell and distribute cannabis through a regulated business as of January 1, 2018.

2015 – The legislature passed the Medical Cannabis Regulation and Safety Act (MCRSA), a series of three bills that created a state licensing and regulatory system for the existing medical market. MCRSA also established the state’s three cannabis licensing authorities – (Bureau of Cannabis Control, CalCannabis Cultivation Licensing, and Manufactured Cannabis Safety Branch). These bills were repealed when MAUCRSA was passed in 2017.

Cannabis Business Permits

The City of Stockton is accepting applications for commercial cannabis businesses.

 

Applications – Delivery, Non-Volatile Manufacturer, and Testing Lab

There is no limit on the number of permits for Delivery, Non-Volatile Manufacturer, and Testing Lab businesses. Interested parties may apply beginning April 4, 2019. 

 

Applications – Retail Storefront, Cultivation, Volatile Manufacturer, and Microbusiness

The City will be issuing two new permits on an annual basis, using a lottery system, for each of these business types:

  • Retail Storefront - Dispensary

  • Cultivation

  • Volatile Manufacturer

  • Microbusiness

Applications for these permits will be accepted for General Pool and Equity Pool each year. Four of the annual permits issued – one per business type – will be reserved for an Equity Applicant. See “Equity Program” below.

 

2020 Commercial Cannabis Business Lottery 

This timeline is provided for applicants interested in participating in the 2020 Commercial Cannabis Business Lottery.

Application and Permitting Process

Each applicant is responsible for reviewing the Stockton Municipal Code and submitting a complete application compliant with all laws and regulations.

To start a cannabis business in Stockton, the City requires these permits:

  • Land Use Permit

    • Provides authorization for land use and location requirements

    • Issued by the Community Development Department

    • Planning Application (Commission Use Permit and Administrative Use Permit)

  • Business License

    • Required for all businesses within the City of Stockton

    • Issued by the Administrative Services Department, Business Licensing Division

  • Operators Permit

    • Required for the business operator

    • Issued and approved by Stockton Police Department

Equity Program

The City will issue half of the permits for Retail Storefront - Dispensary, Cultivation, Volatile Manufacturer, and Microbusiness to Equity applicants. To qualify as an Equity Applicant:

  • Greater than 50% of ownership must be a Stockton resident AND meet ONE of these criteria:

    • Minority Business Enterprise (MBE)

    • Women’s Business Enterprise (WBE)

    • Live in one of Stockton, California Opportunity Zones

    • Live in an SB 535 Disadvantaged Area 

    • Live in a HUD-designated Area

Workforce Diversity Program

The Workforce Diversity Program is a voluntary program for Commercial Cannabis Businesses.  A business will be able to apply for the program during the business license application process and annual business license renewal process.

  • Commercial Cannabis Businesses must meet a 50% diverse workforce requirement during the time of application of the business license or at the time of renewal.

    • To qualify, at least 50% of the business' employees must reside within the SB 535 Disadvantaged Area of the City of Stockton boundaries or reside in the Kelley Drive neighborhood at the time of business license application or renewal.

  • If the threshold is met, the Commercial Cannabis Business will be provided a 50% reduction of the total amount due in taxes based on estimated gross receipts provided at the time of renewal of the business license.

  • Existing Commercial Cannabis Businesses will be able to participate in the voluntary program at the time of their annual business license renewal.

Commercial Cannabis Business Tax Rates

Operators are required to pay a Commercial Cannabis Business Tax based on the revenue received.  

 As of August 15, 2019, the rates are:

  • Storefront Retail (Dispensary) / Non-Storefront Retail (Delivery) - 5%

  • Distribution - 1%

  • Manufacturing (Volatile and Non-Volatile) - 3%

  • Cultivation - 5%

  • Testing - 0%

  • Microbusiness - 5%

The City of Chula Vista, California legalized the sale of adult-use, recreational cannabis in March of 2018. The city accepted cannabis business applications for cannabis manufacturing, cannabis cultivation, cannabis testing, cannabis distribution, cannabis retail, and cannabis delivery. Chula Vista allows for an unlimited number of cannabis manufacturing, cannabis distribution, and cannabis testing labs, with caps on cultivation and delivery.

As of January 21st, 2020, the City of Chula Vista had rejected 20 cannabis business licenses of almost 100 applicants as a result of business owners having criminal records (felony convictions) or failing to submit fingerprints for background checks.

On January 14th 2020, the city eliminated it’s one-year waiting period before someone could reapply for a cannabis business license. This allowed the rejected applicants to adjust their business applications and reapply in February or March 2020.

Information Regarding Posting of QR Codes by Commercial Cannabis Retail Licensees

The Bureau of Cannabis Control (Bureau) is encouraging retailers open to the public to post a QR Code certificate that consumers may scan with their smartphone camera when visiting a commercial cannabis storefront retailer to confirm licensure. Participation in this effort by retail licensees will assist consumers in purchasing legal cannabis goods. Licensees are also encouraged to educate their customers on how to use the QR Code and the importance of shopping at a licensed retailer. The Bureau is providing licensees with an enlarged version of their individual QR Code (QR Code certificate). Storefront cannabis retailers are encouraged to assist the public by prominently displaying their QR Code certificate on the licensed premises in the following manner:

• The QR Code certificate should be visible and scannable from outside the premises.

• The QR Code certificate should be printed on paper not less than 8 ½” by 11”.

• The QR Code itself should not be less than 3.75” by 3.75”.

• The QR Code should be posted in the front window of the licensed premises or in a locked display case mounted on the outside wall of the licensed premises within three (3) feet of any public entrance to the licensed facility.

• The QR Code should be posted in a manner that is clearly visible from outside of the licensed premises by all persons entering the premises and shall be of sufficient clarity that the code can be read by a smartphone or device capable of reading QR Codes from a distance of at least three (3) feet.

Consumers can confirm that the retail location is properly licensed by using a phone camera or QR Code app to scan the QR Code certificate. Once scanned, the consumer will automatically link to a URL that confirms the cannabis retailer’s license status. The website will display the address and business license of the location to ensure that the retailer at that location is licensed. By providing commercial cannabis consumers with an easy method for verifying licensure status, the Bureau and its licensees can work together to reduce the potential risks that may come from the purchase of non-compliant cannabis goods from unlicensed retailers.

CITY OF DAVIS- Depending on the decision made by the Yolo County Board of Supervisors next spring, the new addition could either increase or decrease cannabis activities in unincorporated parts of Yolo County. 

The draft has five proposed options that vary in the authorized types of cannabis activities, the zoning location and buffer requirements and the total number of operations. The first option has the smallest number of licenses and only allows cultivation activities of the current 78 existing operations. 

The second and third alternatives allow all types of cannabis use and have higher numbers of allowed operations (132 and 264, respectively). The fourth alternative only allows operations indoors or in greenhouses. And the fifth would limit the operations to agricultural zone districts besides retail. 

Comments for the DEIR can be submitted by the public until Dec. 23 at 4 p.m. and written comments can be sent to the Yolo County Department of Community Services. Oral comments can also be made at the Yolo County Planning Commission Meeting on Dec. 3. The Davis meetings will occur on Dec. 2 at the South Davis Citizens Advisory Committee Meeting and on Dec. 3 at Unitarian Church in West Davis.

Sacramento Serves Warrants to 24 Unlicensed Dispensaries

SACRAMENTO – The Bureau of Cannabis Control (Bureau) and the Department of Consumer Affairs’ Cannabis Enforcement Unit (DOI-CEU) today announced a series of enforcement actions against illegal cannabis retailers operating in Los Angeles.

Search warrants were served on 24 unlicensed locations over a 3-day period from December 10 to December 12 and resulted in the seizing of $8.8 million in cannabis and cannabis products. Enforcement staff also confiscated 9,885 illegal vape pens and $128,742 in cash.

“This week’s collaborative enforcement efforts were a huge success,” said Bureau Chief Lori Ajax. “We look forward to working with local jurisdictions and law enforcement as we continue to shut down unlicensed operators in the illicit cannabis market.”
